Terms of Service

By accessing or using Pilot Partners S.L.'s website (pilot-partners.com), tool platform (tool.pandltoscale.com), or consulting services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Pilot Partners S.L. provides:

• ·Consulting services: Amazon account management, PPC optimization, operational strategy, and brand growth services.
• ·Tool platform: AI-powered tools including Listing Builder, Image Studio, and upcoming analytics features.
• ·Amazon SP-API integration: Connection to your Amazon Seller account for data analysis and operational management.

Services are provided on a subscription or project basis as agreed in your individual service proposal.

You are responsible for:

• ·Providing accurate and complete information during registration.
• ·Maintaining the confidentiality of your account credentials.
• ·All activities that occur under your account.
• ·Notifying us immediately of any unauthorized use.

Account sharing is prohibited. Each user must have their own account credentials.

You agree not to:

• ·Use our services for any unlawful purpose.
• ·Violate Amazon's Terms of Service, Seller Code of Conduct, or any applicable Amazon policies.
• ·Attempt to access data belonging to other users.
• ·Reverse engineer, decompile, or disassemble our platform.
• ·Use automated tools to scrape or extract data from our platform.
• ·Misrepresent your identity or authorization.

Violation of these terms may result in immediate suspension or termination of your account.

Pilot Partners S.L.'s IP: Our platform, tools, algorithms, branding, and content are protected by intellectual property laws. You may not copy, modify, or distribute our platform or its components.

Your Content: You retain ownership of all data and content you provide to our platform, including product information and images.

AI-Generated Content: Listings, images, and other content generated by our AI tools are provided for your use. You receive a non-exclusive, perpetual license to use AI-generated content for your Amazon business.

You retain full ownership of your Amazon data at all times. By connecting your Amazon account, you grant us a limited license to access and process your data solely for providing our services. This license terminates when you revoke OAuth access or terminate your engagement.

You may request export of your data at any time.

• ·Platform availability: We target 99.5% uptime for our tool platform, excluding planned maintenance.
• ·Planned maintenance: Scheduled during low-traffic hours (weekends, 02:00-06:00 CET) with advance notice when possible.
• ·Support response: First response within 1 business day; critical issues within 4 business hours.
• ·Incident communication: We will notify affected users of significant service disruptions via email.

Our platform relies on third-party services including Amazon SP-API, OpenAI, fal.ai, and Vercel. We do not guarantee the availability, accuracy, or performance of these third-party services.

Changes to Amazon's SP-API, policies, or terms may affect our ability to provide certain features. We will communicate significant impacts to affected users.

To the maximum extent permitted by law:

• ·Pilot Partners S.L. shall not be liable for indirect, incidental, special, consequential, or punitive damages.
• ·Our total liability for any claim shall not exceed the fees paid by you in the 12 months preceding the claim.
• ·We are not liable for losses resulting from Amazon policy changes, SP-API modifications, or third-party service failures.
• ·Force majeure events (natural disasters, pandemics, government actions) excuse performance obligations.

By you: You may terminate your engagement at any time by providing written notice to hello@pilot-partners.com.

By us: We may terminate or suspend your account for violation of these terms, non-payment, or for any reason with 30 days' written notice.

Effect of termination:

• ·You will have 30 days to export your data.
• ·All Amazon SP-API tokens will be revoked and data deleted within 30 days.
• ·Outstanding invoices remain due.
• ·Provisions that by their nature should survive (liability, IP, confidentiality) will continue.

These terms are governed by the laws of Spain. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the Courts and Tribunals of Barcelona, Spain.

We may modify these terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the modified terms.
